The Muslim population had increased substantially from 579,640 in 2001. Immigration is an important part of this diversity: in 2021, immigrants represented 63.1% of Canada's Muslim population.

The Muslim population is also relatively young, with a median age of about 30 years compared with 41.2 years for the overall population. The community includes people with roots in South Asia, the Middle East, North Africa, Africa, the Balkans and many other regions.

There is no single cultural model for Muslims in Canada. Large communities have roots in Pakistan, India, Bangladesh, Iran, Iraq, Afghanistan, Egypt, Lebanon, Somalia and many other countries.

Language can vary significantly. English and French are widely used in Canadian society, while many Muslim households also use Arabic, Urdu, Bengali, Somali, Persian, Turkish and other languages. This diversity means being Muslim does not automatically mean two people have the same expectations.

Muslim Marriage Law and Customs in Canada

Marriage law in Canada is governed by a combination of federal and provincial or territorial rules. The federal Civil Marriage Act establishes important requirements including free and informed consent and a minimum age of 16 under federal law.

A religious Nikah does not automatically become a legally recognized Canadian marriage simply because it was performed by an imam. The legal requirements depend on the province or territory, including whether the religious officiant is legally authorized to solemnize marriages.

A couple can have a civil marriage and then conduct a separate Nikah according to their religious traditions. Canadian law does not allow a person to be legally married to more than one spouse at the same time.

A previous marriage must have been dissolved by divorce, death or a court declaration of nullity before another legal marriage can take place.

Rules can change. Always confirm the current marriage requirements with the relevant provincial or territorial authority before making plans.

What Makes Muslim Marriage in Canada Different?

Canada's Muslim community is large and highly diverse. The 2021 Census counted nearly 1.8 million Muslims from many different countries and generations. Some may prefer:

  • A spouse who was born in Canada
  • Someone from a similar cultural or ethnic background
  • Someone who speaks English or French
  • Someone who also speaks Arabic, Urdu, Bengali, Somali, Persian or another community language
  • Someone who is practising
  • Someone who is open to marrying a convert
  • Someone already living in Toronto, Montreal or another Canadian city
  • Someone willing to relocate within Canada
  • Someone willing to relocate internationally

These preferences are personal and can differ significantly from one person to another. A serious matching process therefore needs to consider compatibility rather than matching people simply because they are both Muslim.

Immigration

Bringing a Spouse to Canada

Canada has a dedicated family sponsorship program that allows eligible Canadian citizens and permanent residents to sponsor a spouse for permanent residence. The program is currently open.

One useful feature of Canadian spousal sponsorship is that, in most cases, there is no minimum income requirement for sponsoring a spouse or partner. The sponsor must sign an undertaking agreeing to provide financial support for three years.

A spouse living outside Canada can apply through the Family Class sponsorship route. Canada's program explicitly allows foreign nationals to apply from overseas.

Marriage to a Canadian citizen does not automatically give a foreign spouse Canadian citizenship. One major requirement is physical presence in Canada for at least 1,095 days during the five-year eligibility period.
